Konstantin Ewald
Konstantin Ewald is the head of Technology, Media & Telecommunications in Osborne Clarke Germany.
With over twenty years of experience of advising on strategic technology projects, digital regulation, ecommerce, consumer law and interactive entertainment, he is recognised as one of the leading IT, digital media and entertainment lawyers in Germany.
He is a specialist in ecommerce law with a special focus on consumer law and multi-jurisdictional platform compliance projects. Konstantin has been advising leading Internet companies as well as traditional businesses on product launch issues, including commercial agreements, platform terms and conditions, regulated activities and platform liability. Together with his multi-jurisdictional team, he has assisted several online platforms in preparing for their designation as Very Large Online Platforms under the Digital Services Act (DSA). He regularly defends online businesses against enforcement actions by both consumer protection organizations as well as regulators.
Konstantin regularly acts for major computer and mobile games developers and publishers as well as other rights owners who are licensing rights for use in interactive software products. He regularly advises clients during the product development phase, providing advice about how to design games/apps and other digital media products to avoid claims for infringement and to comply with privacy and youth protection regulations.
Additionally, Konstantin advises clients in IP-driven transactions, particularly in VC, M&A and other corporate transactions. He often acts as a trusted advisor to emerging, high-growth and mature technology and digital media companies.
Konstantin has published the first legal handbook on mobile apps and is editor-in-chief of Germany’s leading blog about legal aspects of games Video.Games.Law. He has been recognised by industry leaders, including being listed as a leading partner by Legal 500 for information technology and digitalisation and having Osborne Clarke JUVE law firm of the year for use of IT & Data Protection and Technology & Media several times under his leadership.
I like providing strategic advice to great companies and helping clients to navigate through the opportunities and risks presented by novel technologies and complex transactions and business models. I translate legal advice into business consequences and business actions. I provide proactive problem-solving, creative strategic thinking and a 360 view on the relevant topic.
Clients and peers emphasize his “substantial expertise and profound transactional know how“ and “high responsiveness”. They praise him as "super committed and strong negotiator", as well as “unbelievably knowledgeable of the industry".
