BDRD Side Event | Counting the (Institutional) Cost: An Oxford-Style Debate on Time Spent v Amount in Dispute

Should arbitrators’ fees be determined by the value of the dispute or by the time spent deciding it?

During this interactive Oxford-style debate, jointly hosted by Osborne Clarke, the LCIA and the LCIA’s Young International Arbitration Group (YIAG), two teams of experienced arbitration practitioners will argue the merits of the two principal models of arbitrator remuneration. One side will defend the ad valorem approach adopted by institutions such as the ICC and DIS, while the other will advocate the hourly-rate model used by the LCIA.

Beyond the mechanics of fee calculation, the debate will explore the broader policy considerations behind each model, including efficiency, proportionality, predictability and the incentives created for tribunals, parties and arbitral institutions.
