Osborne Clarke advised the U.S.-based Fall Creek Group on its acquisition of Berrytech and Berryplant—two leading Italian companies based in the Trentino region that specialise in the genetics, hybridisation, and propagation of raspberries and blackberries.

Fall Creek Farm & Nursery Inc. (a privately held group that has been active worldwide for over 50 years) is a global leader in the genetics, propagation, and cultivation of blueberries. Through this complex transaction, the company aims to expand its operations into the genetics and production of other berries (such as raspberries and blackberries) and to strengthen its presence in European markets.

Fall Creek was advised by Osborne Clarke, with a team led by Partner Filippo Palmieri  and comprising Senior Associates Luigi Achille and Giulia Verusio for corporate matters and Associates Giuliano Giaquinto and Fabrizio Ducci for regulatory matters. The Osborne Clarke team worked in close coordination with Fall Creek’s legal team, led by Ines Buiza Calero, Senior Legal Counsel EMEA.

This transaction marks Fall Creek’s strategic entry into the Italian market in a key sector—food genetics—which is poised for significant growth in the coming years, driven by increasingly widespread mergers and partnerships globally, and particularly in Europe, with a decisive focus on food quality and safety.
