Green Claims in Fashion: The New Legal Framework for Environmental Advertising

"Sustainable", "eco-friendly", "climate-neutral" – whether used in connection with fibre sourcing, production conditions or corporate-level commitments such as net-zero targets, these claims are ubiquitous in fashion. With the transposition of the so-called EmpCo Directive (Empowering Consumers for the Green Transition Directive – EU Directive 2024/825) into German law, they are also subject to significantly stricter rules: without sufficient substantiation, brands risk warning letters, injunction proceedings, competitor damages claims and administrative fines of up to EUR 50,000 or, in individual cases, even EUR 1.25 million.
