Getting to grips with overlapping areas of regulation is a constant challenge for businesses. The Court of Appeal has held that compensation claims for non-material damage under the General Data Protection Regulation (GDPR) do not need to meet a threshold of seriousness, and that fear alone can be sufficient to found a claim.
