In a follow up to our last podcast in which we looked at potential collateral claims and duty of mitigation, Ian Hyde and Katherine King are back to discuss issues arising in relation to collateral claims and examine in detail the question of what to do in order to avoid the collateral claim against the third party becoming time-barred.

Tax appeals can take a long time and the issue of limitation needs to be addressed early on – especially where there is a potential indemnity claim, where often there is a shorter limitation period. There are also difficulties to be considered when trying to work out exactly when time starts running.

This podcast also discusses the position where there is a potential professional negligence claim to be brought, and the practicalities and advisability of entering into a standstill agreement with the third party.
