The Building Safety Act 2022 aims to create a new system of regulation and accountability in the construction and operation of high-rise residential buildings in England. The demand for a fairer, safer and more modern regulatory framework for the building industry was driven by devastating incidents which exposed major flaws in the previous system. However, the Act comes with its own complexities and controversies. In this briefing, we consider the impact of the Act on financing tall buildings with a residential element (in England only) and some of the issues that lenders will need to consider in structuring, investigating and documenting the debt financing of such buildings.
