Towards a Sustainable Fashion Industry – Introduction to Key Issues

The increasing focus on sustainability and environmental responsibility is changing the legal and regulatory landscape affecting the fashion and luxury industry, providing new challenges for manufacturers, distributors, and retailers.

A number of initiatives have been implemented recently aimed at greening the fashion sector. The German “Supply Chain Act” was approved in June this year and will require German companies to ensure that their supply chains follow certain human rights and environmental standards. Furthermore, fashion brands are increasingly focusing on biodiversity considerations as a result of various pressures, including to be a “responsible business”. There are also indications that regulatory change may be on the horizon for companies that have a significant impact on biodiversity.

At the same time there are numerous legal pitfalls when fashion firms incorporate sustainability and environmental protection into their advertising claims. Greenwashing is risky; companies making false claims may find themselves subject to legal action from consumer-rights organisations or other groups. Some retailers have even been investigated or warned by authorities and watchdogs for exaggerating their sustainability claims.
