The need for pragmatic but accurate advice on the EU public procurement rules has never been greater. The updated and consolidated
EU procurement Directives have introduced new tendering procedures and more effective remedies for non-compliance. This has
led to a much greater awareness of the EU public procurement regime, for example, from aggrieved parties seeking advice on
bringing public procurement complaints. In addition, there is growing demand from central and local government and utilities
on the application of the EU public procurement rules as they create increasingly complex procurement models.
We regularly advise both private contractors and awarding authorities, giving us a wide-ranging understanding of the procurement
regime from both perspectives.
We advise and assist awarding authorities on:
- whether they fall within the scope of the procurement directives;
- the procurement process for procuring works, services and supplies, from start to finish;
- drafting compliant contract notices and developing short-listing and tender documentation to ensure that tenderers respond
in a concise yet comprehensive manner.
We also advise and assist tenderers on:
- responding to invitations to tender;
- whether ITNs are compliant with the procurement rules;
- making requests for information under the Freedom of Information Act;
- challenging decisions and bringing public procurement litigation.
Osborne Clarke has been awarded one of the first L-CAT framework agreements from OGC Buying Solutions, which recognises our
ability to advise on all aspects of a UK public procurement process.
We have particular experience of advising clients in the natural resources, health and education sectors.
With public procurement specialists across Europe, we can offer a pan-European service.
Examples of our recent experience include:
- Advising a university on the use of framework agreements
- Advising a local authority on the application of the EU procurement rules to a renewables energy project and preparing all
of the tender documentation
- Advising the then-preferred private sector partner on the public procurement aspects of the Plymouth Local Improvement Finance
