The current issue for funders is that of extreme competition to find the right property or land to finance.

Our property finance lawyers advise borrowers and a wide range of domestic and international banks and lending institutions, as well as investment trusts on all aspects of secured and unsecured finance.

We are involved in drafting and negotiating complex syndicated loan facilities, revolving credit facilities, mortgage book acquisitions, refinancing of existing facilities, development finance, and funding to the not-for-profit sectors. Innovative partnerships are increasingly involving funders in joint venture deals with corporate occupiers and landowners, with financing involving equity, mezzanine and senior debt. Whilst the proposed tax-transparent Real Estate Investment Trusts (REITs) and new Local Investment Finance Trust (which gains private investment in infrastructure for NHS facilities) will increase the type of investor and investment vehicles.

All our property finance clients share one thing in common; they receive expert advice (delivered in a plain English style) on putting together financial structures and forms of ownership to meet the requirements of individual transactions. The Legal 500 2004 recognises this, stating: “[Nadine Strahl] provides an 'excellent service.'"

Examples of our recent experience include:
  • advising Allied Irish (UK) on the provision of loan facilities to assist in the acquisition of a hotel and a refinancing of a hotel
  • acting for the Royal Bank of Scotland Plc on the provision of loan facilities to a newly formed fund to assist in the acquisition of the head leasehold and freehold interests in 36 Golden Square, W1
  • acting for Northern Rock on circa £30M loan facility to purchase an mixed portfolio of investment properties
