Those in the construction industry with responsibility for procurement are being encouraged to take a pragmatic yet commercial approach to their projects. Trying to achieve commercial objectives, whilst leaving minimum opportunity for disputes to arise, makes contracting all the harder.

Osborne Clarke’s Construction team is one of the largest specialist teams based outside London. According to Chambers & Partners 2005, we are "commercial and knowledgeable" negotiators. We advise a wide cross-section of the construction and engineering community, in both the private and public sectors on commercial issues.

Our procurement experience includes drafting and negotiating suites of construction documentation on a whole range of procurement methods, including PFI/PPP and LIFT. The projects we have advised on have been very diverse and cover both building and engineering developments. We ensure our clients' interests are safeguarded, whilst keeping a firm hand on commercial issues.

Examples of our recent experience include:
  • acting for Fred Olsen Renewables Limited regarding the construction of several wind farms within the UK. This has involved the negotiation of complex contracts with both UK and foreign contractors.
  • preparing and negotiating a suite of construction documents for the University of Bath in relation to its multi million pound sports facility
  • reviewing, negotiating and settling professional appointment and direct agreements/collateral warranties with sponsors (Gleesons and Balfour Beatty respectively) for Colchester & Tendring LIFT and West Park, Darlington Mental Health Unit PFI
