Innovative media requires innovative legal solutions. Converging technologies have added a complex new dimension to content, with many platforms and content providers turning to digital and interactive forms of entertainment. Keeping abreast of the multimedia revolution and how it impacts on your business calls for specialist legal advisers.

Osborne Clarke is one of the recognised leaders in the media and entertainment sectors. According to Chambers & Partners 2005, our “profile in the market is on the ascent, partly due to its reasonable, prompt and commercial service." We have extensive experience of representing producers, media owners, talent and financiers in the film, television and radio industries, as well as publishers, multimedia developers, and online services providers.

Commercial - We advise on contracts of all kinds, including development, production, co-production, syndication, licensing and talent contracts, management deals, joint promotional activity, merchandising and sponsorship deals and branded content agreements, including advertiser-funded programming (AFP) deals.

We also help clients draft and negotiate the legal agreements required to create, publish and distribute interactive and online multimedia products, including those for acquiring content such as video, photographs, film, audio, data, books and music (including streaming of music, supply of ring tones and obtaining all relevant PRS and MCPS licences).

Intellectual property - Our IP advice includes copyrights, trademarks, idea submission and misappropriation, licensing and development agreements.

Disputes - We also handle IP and entertainment business disputes, including claims of idea theft and plagiarism of copyrighted works, as well as commercial misappropriation of celebrity name, voice or likeness.

Corporate - We have extensive experience of advising independent producers and production companies on corporate structuring, formulating split-rights deals and funding rounds. This includes strategic acquisitions (M&A) and flotations (IPOs) on the UK Stock Exchange, AIM and full lists.

We are an active member of PACT (the Producers Alliance for Cinema and Television), Raindance and the Royal Television Society. Members of the team regularly lecture on film and TV production to PACT members, the Film Council of England, Raindance and South West Screen.

Examples of our recent experience include:
  • advising Wark Clements & Company Ltd on underlying rights and production agreements in respect of several children's and youth live action drama and animated episode television series and live action feature films.
