The Government's commitment to education is manifesting itself in various ways. The ambitious Building Schools for the Future programme envisages the rebuilding of every secondary school in the country through a £15 billion investment. City Academies are being developed and financed jointly by the public and private sectors. The continuing VAT burden on the educational sector continues to make the effective structuring of capital projects from the point of view of tax and VAT essential.

Our clients include the Universities of Bath, Bristol and Plymouth and a range of independent schools and educational charities. The main areas of education sector advice include procurement of goods and services, including advising project sponsors on PFI/PPP education projects. We advise on information technology contracts; on corporate structures, including spin-out companies; major construction projects (including drafting and negotiating suites of construction documentation and advising on appointments of contractors); charity law; pension schemes; employment; and property transfers and management.

We advise universities (including the Universities of Bristol and the West of England) on major funding agreements, typically with the Department of Health, as well as in relation to the funding and structure of spin-out companies. We have recently advised an educational charity in relation to City Academies and implemented a number of incorporations for several long established cathedral schools.

Examples of our recent experience include:
  • advising Tribal Education on its intervention in the Swindon LEA
  • advising a short-listed bidder on a tranche of pathfinding e-learning education PFT projects (Lambeth and Warwickshire).
  • advising a UK university on the commercial development and exploitation of its unit specialising in research into micro-organisms
