Pensions Alert - Date set for Union appeal of High Court decision on CPI switch

We reported here that on 2 December 2011 the High Court ruled unanimously against the challenge by several public sector unions seeking judicial review of the Government's decision to switch the basis on which public sector pensions are indexed to the lower CPI from the traditionally higher RPI. Leave to appeal was subsequently granted on two of the four grounds of the unions' challenge: (1) whether or not the adoption of CPI was consistent with the Government's statutory obligation and (2) whether or not Government took into account irrelevant considerations because its motivation was reduction of the UK deficit. The unions have come together in separate groups to lodge two separate appeals. However, both appeals will be heard at the same time in the Court of Appeal on 20 February 2012.

We will report on the outcome of the appeal when it is known.
